Use of Jamego, including the posting of any information on the Jamego Web Site, constitutes your understanding and acceptance of the following terms without variation, modification or amendment:

• Jamego is the trade name of Snowdon Technologies Limited a duly registered company under the laws of New Zealand, having its registered office at Christchurch, New Zealand.


Purpose of this Service

• Jamego provides users with access to instant messaging services. The purpose of the service therefore is to allow users to gain access to information which would not otherwise be available to non Licencees whilst providing a forum where likeminded people can exchange ideas and views about relevant topics and topics of interest. Please be aware this service is being provided for persons who share the same interest, however, the views expressed in this service are those of the Licensees only. Therefore, whilst Jamego is under no obligation to monitor any of the communications posted on the site, Jamego will use its reasonable endeavours to ensure offensive material is not posted on this site and, once aware of the presence of such material, will remove both the offending material and any Licensee posting such material.


Modification Of These Terms Of Use

• Jamego reserves the right to change the terms, conditions, and notices hereof including but not limited to the charges associated with the use of the Jamego Web Site. You are responsible for regularly reviewing these terms and conditions and additional terms posted on particular websites. Your continued use of the Jamego Web Site constitutes your agreement to all such terms, conditions, and notices.


Licensing

• Because the service provided by Jamego is aimed at adults, access to the service is fee based and its use will incur a monthly charge at the rate of 5.50 (local currencies are NZD, AUS, USD, GBP and SA. Default is USD if a local system currency is not selected). Jamego's monthly licenses are based on 30 day's access from the time of registration and any refund for early termination is at the sole discretion of Jamego. Because this is a pay service Jamego requests that you gain the consent of the individual or individuals paying the Bills before you obtain a license to this service. Please note, Jamego retains, at its sole discretion, the right to alter the rate of the license without notice to Licensee's, although we will use reasonable endeavours to ensure Licensees are aware of any change in pricing policy. Jamego shall not be liable in the event the Licensee is not responsible for the payment of bills. In consideration for the licensing fee you will receive, if you are a FreeJam Licensee 25 SMS messages per month, for notifications purposes only, however, additional SMS messages may be purchased from Jamego, alternatively, if you are a Jamego Jazz licenses you will receive 50 SMS messages per month for notification purposes only, however, additional SMS messages may be purchased from Jamego. Only the additionally purchased SMS notifications messages will be carried over to the next month.


Registration

• In obtaining a license to the service you will be required to provide information about yourself. This information will be used for registration purposes only and to enable us to provide the best service we are able to. Please be aware, however, that, Jamego may be compelled by law to disclose certain information and by obtaining a license to this service you accept such disclosure.
• In consideration for the service you agree to provide true, accurate, current and complete information about yourself and to promptly update this information if the information provided subsequently becomes untrue or incorrect. You warrant that all information submitted, either at the date of registration or subsequent thereto, is true and accurate (including without limitation your credit card number and expiration date), and you further agree to pay all licensing fees you incur plus all applicable taxes. Jamego retains the right to prohibit future licensing and/or terminate any account where the information provided is inaccurate or incorrect or there has been a failure to make payment when due.
• Upon registration you will be provided with a user name and password, it is your sole responsibility to keep these confidential and you must contact Jamego promptly on becoming aware some other person knows your user name and password, whereupon you will be issued with a new username and password. Jamego shall not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. Your license is personal to you and the members of your household, you may not transfer or make available your account name and password to others, including without limitation your co-workers, employees, friends or colleagues.


Member Conduct

• By accepting these terms and conditions you hereby warrant and represent that you will use Jamego only in a manner consistent with and in furtherance of the purposes of Jamego. Jamego expressly disclaims any control of the messages, information or files delivered to the site and, while Jamego will use reasonable endeavours to ensure that the comments posted are not offensive, Jamego shall not be responsible for any such postings.
• The messages, opinions and other material an individual user posts are the sole responsibility of that user and Jamego accepts no responsibility for the accuracy, integrity or availability of any information posted. This means that you, and not Jamego, are entirely responsible for all content that you upload, post, email, transmit or otherwise make available via the Service. You understand that by using the Service, you may be exposed to content that is offensive, indecent or objectionable. Under no circumstances will Jamego be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available via the Service.
• As a condition to the use of this site you agree:

1.	That you do not restrict or inhibit any other user from enjoying or being able to use Jamego.
2.	Refunds will be given at the discretion of the Company Management.
3.	That you will not post, or cause to be posted, any material that is, or may be, considered by a reasonable person to be harmful, invasive of publicity or privacy rights, threatening, abusive, harassing, defamatory, libellous, vulgar, obscene, profane, hateful, offensive, illegal or otherwise objectionable or that would constitute or encourages or promotes a criminal or civil offence or otherwise give rise to any form of liability, or that discriminates on the basis of race, gender, sexual orientation or ethnicity, or that insults the victims of crimes against humanity by contesting the existence of those crimes.
4.	That you will not post or transmit any information, software or other material which violates or infringes, or may violate or infringe the rights of others, including material which is or may constitute an invasion of privacy or publicity rights or which is protected by copyright, trademark or other proprietary interest, including derivative works thereto, without first obtaining permission from the owner or right holder.
5.	That you will not intentionally or unintentionally violate any applicable local, state, national or international law.
6.	That you will not impersonate any person or entity, including but not limited to, a Jamego employee or volunteer, or falsely state or otherwise misrepresent your affiliation with a person or entity.
7.	That you will not post or transmit any information, software or other material which contains a virus or other harmful component.
8.	That you will not post, upload, distribute or otherwise publish materials soliciting funds, promoting, advertising or offering for sale any goods or services, including soliciting other users for other commercial online services or rights to participate without the prior express written approval of Snowdon Technologies Limited.
9.	Stalk or otherwise harass another member;
10.	Collect or store personal data about other users;
11.	Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consents to do the same.
12.	Upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another.
13.	Harvest or otherwise collect information about others, including e-mail addresses.

• In addition, you specifically agree that Jamego is not responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another's rights, including intellectual property rights. You specifically agree that Jamego is not responsible for any content sent using and/or included in a Jamego site by any third party.
• Jamego reserves the right to prohibit and remove any conduct, communication or content it deems in its discretion to be harmful to individual users or other third-party rights, or to violate any applicable law. Jamego reserves the right to bar any user who fails to observe the terms of this policy, and these terms shall terminate immediately without notice from Jamego if in Jamego's sole discretion a user fails to comply with any of the provisions of these terms.
• Jamego reserves the right to monitor chat room communications for adherence to this policy and may disclose any content, record or electronic communication, of any kind, including user email:

(1)	to satisfy any law, regulation or authorised governmental, whether Central or Local, request;
(2)	if such disclosure is necessary to operate chat room communications;
(3)	to protect the rights or property of Jamego, a Jamego user or the public; or
(4)	if otherwise compelled by law,

• and you hereby indemnify and hold Jamego harmless for so disclosing.


Links To Third Party Sites

• The Jamego Site may contain images of and links to third party Web sites. Such third party Sites are not under the control of Jamego and Jamego expressly disclaims any responsibility for the contents of any such sites, including without limitation, any additional link from the third party site. Jamego is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Jamego of the site or any association with its operators. You are responsible for viewing and abiding by the privacy statements and terms of use posted at the Linked Sites.
• Any dealings with third parties (including advertisers) included within the Jamego Site or participation in promotions including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between you and the advertiser or other third party. Jamego shall not be responsible or liable for any part of any such dealings or promotions and expressly disclaims any warranty in any goods so purchased.


Special Admonitions For International Use

• Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from New Zealand or the country in which you reside.


Termination

• You agree that Jamego, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, if Jamego believes that you have violated or acted inconsistently with the letter or spirit of the Terms and Conditions. Jamego may also in its sole discretion, and at any time, discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of these terms and conditions may be effected without prior notice, and acknowledge and agree that Jamego may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that Jamego shall not be liable to you or any third-party for any termination of your access to the Service.


Indemnity

• You agree to indemnify and hold Jamego harmless from any claim or demand, including reasonable solicitors' legal fees, made by any third party due to or arising out of your violation of these terms and conditions or your violation of any rights of another.


Violations

• Jamego encourages all Licencee's to report any violations of the terms and conditions directly to feedback@jamego.com


Severance

• If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.


Jurisdiction

• Any proceeding, action, matter or dispute arising out of or elated to use of the Jamego Site, these terms and conditions, any act of Jamego or any other matter arising out of or connected with the use of Jamego or services supplied by Jamego shall be subject to the exclusive jurisdiction New Zealand Law with venue in Auckland, New Zealand and you hereby irrevocably submit and consent to the exclusive jurisdiction of the Courts of New Zealand.

DISCLAIMER OF WARRANTIES

YOU AGREE THAT USE OF THE JAMEGO LICENSE IS ENTIRELY AT YOUR OWN RISK. JAMEGO SHALL NOT BE RESPONSIBLE FOR ANY CONTENT FOUND ON CHAT. THE JAMEGO LICENSE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION, SERVICES, UNINTERRUPTED ACCESS OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE JAMEGO LICENSE. SPECIFICALLY, JAMEGO DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: (1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES; AND (2) ANY WARRANTIES OF TITLE OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER OF LIABILITY, INCLUDING DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL, APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. YOU SPECIFICALLY ACKNOWLEDGE THAT JAMEGO IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH YOU. NEITHER JAMEGO NOR ANY OF ITS PARENT OR MEMBER COMPANIES, AGENTS, AFFILIATES OR CONTENT PROVIDERS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE JAMEGO LICENSE OR INABILITY TO GAIN ACCESS TO OR USE THE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY. YOU HEREBY ACKNOWLEDGE THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL CONTENT ON JAMEGO.
